Bankruptcy (POC Rule)


On February 10, 2014, Attorney General Eric Holder issued a memorandum stating that all the laws, regulations and policies that are enforced, administered or interpreted by the Department of Justice (DOJ) will recognize the marriages of same-sex couples regardless of where the couple resides. Under this policy, the DOJ will take the position in legal proceedings that same-sex spouses should have the same legal rights as different-sex spouses, including the right to decline to give testimony that might violate the marital privilege and the right in bankruptcy cases to file jointly.  DOJ will recognize such marriages as valid based on the "place of celebration," regardless of where the couple resides.
